Commissioners Proceedings

On January 19, 2010, the Board of Commissioners of Cavalier County, North Dakota, met at the Cavalier County Courthouse in regular session, with all members present.  Chairman Harold Nowatzki presided and proceeded as follows:

Harvey Hope made a motion to approve the minutes, seconded by Alvin Carlson, motion carried.

Richard Flanders made a motion, seconded by Harvey Hope to review and approve the following audit of claims, motion carried:

Jon Markusen from Kadrmas, Lee & Jackson Inc. met with the commissioners to discuss the possibility of another stimulus payment coming from the federal government.  The discussion was to possibly do an overlay on the three miles south of Osnabrock to Hwy. 66, since it met the requirements of the stimulus package, if it happens.

The commissioners were informed by the Auditor that Dale Uhrich did the electrical in the food pantry with an overhead light, switch, and some other electrical work as a donation to the food pantry.  Uhrich took a vacation day at work to do the work.

Alvin Carlson made a motion, seconded by Harvey Hope to accept the pledge of securities for First State Bank of Munich in the amount of $250,000.00, motion carried.  Harvey Hope made a motion, seconded by Richard Flanders to accept the pledge of securities for Farmers and Merchants State Bank in the amount of $2,114,316.65, motion carried.  Tom Borgen made a motion, seconded by Harvey Hope to accept the pledge of securities for Bank of North Dakota/Choice Financial in the amount of $500,000.00, motion carried.

Harvey Hope made a motion, seconded by Alvin Carlson, to amend the Farm to Market budget in the amount of $102,550.00, motion carried.  Richard Flanders made a motion, seconded by Harvey Hope, to amend the Road and Bridge budget in the amount of $12,000.00, motion carried.  Tom Borgen made a motion, seconded by Alvin Carlson, to amend the 2006 FEMA budget in the amount of $60,100.00, motion carried.   Richard Flanders made a motion, seconded by Harvey Hope, to amend the 2007 FEMA budget in the amount of $105,800.00, motion carried.  Harvey Hope made a motion, seconded by Tom Borgen, to amend the 2009 FEMA budget in the amount of $1,100,000.00, motion carried.  Alvin Carlson made a motion, seconded by Tom Borgen, to amend the 2004 FEMA Adm. budget in the amount of $250.00, motion carried.  Harvey Hope made a motion, seconded by Alvin Carlson, to amend the 2007 FEMA Adm. budget in the amount of $35.00, motion carried.   Richard Flanders made a motion, seconded by Harvey Hope, to amend the 2009 FEMA Mgmt. Costs budget in the amount of $44,000.00, motion carried. All amendments made were due to unanticipated expenses and grant reimbursed expenditures.  In reviewing the budgets from 2009, the commissioners commended the department heads for staying within their budgets.

The commissioners discussed the Mulberry Creek Phase III Project that the Water Board is projecting.  If the project goes through, Alvin Carlson made a motion, seconded by Harvey Hope, to approve the Certificate of Indebtedness against the taxes on the construction on this Mulberry Creek Phase III Project for the Water Board, motion carried.

Ted Dahl, Social Service Board, and Jill Denault, Social Service Director, met with the commissioners to discuss a vehicle for the department that was approved in the Social Service budget.  After some discussion, the commissioners gave Dahl and Denault the approval to look into getting a new vehicle or one with very few miles.

There was some discussion on what should be advertised for some of the equipment that is no longer used by the County.  The 1980 Ford truck, a single axle 1983 truck, and a hand tamp for culverts, would be advertised in the newspaper for two weeks and bids would be opened on February 2, 2010, the next commission meeting.

Tom Borgen made a motion, seconded by Harvey Hope, to transfer $43,587.87 from Special County Highway Fund to Road and Bridge Fund, motion carried.  Richard Flanders made a motion, seconded by Alvin Carlson, to transfer $19,076.39 from Social Security Fund to Health Insurance Fund, motion carried.  Alvin Carlson made a motion, seconded by Richard Flanders, to transfer $46,000.00 from County Poor Fund to Social Welfare Fund, motion carried.  Alvin Carlson made a motion, seconded by Harvey Hope, to transfer $17.50 from Weed Fund to Road and Bridge Fund, motion carried. Harvey Hope made a motion, seconded by Tom Borgen, to approve amending the miscellaneous revenues in the amount of $23,400.00, motion carried.

The supervisors from North Olga Township met with the commissioners.  The questions on the North Olga/Sherette Hill, Terry Johnston, Road Supervisor, will look into and get back to the commissioners.

Von Christianson, Snow Plow Operator, met with the commissioners to discuss his work in LaMoure Township, Pembina County.  Christianson was wondering if the County’s liability policy covers him when he is in Pembina County, and State’s Attorney Scott Stewart assured him it did.  Christianson will get a Joint Powers Agreement from the Auditor for Pembina County.

Scott Stewart also talked to the commissioners about the railroad agreement, and after some discussion, Stewart explained to them that he would be back on February 2, 2010 at 11:00 a.m. to discuss the signing of the agreement with the railroad.  Stewart stated his intention is to then have a public meeting with all the landowners upon completion of this agreement, and discuss the extent of the ownership and deeds.

Harvey Hope made a motion, seconded by Tom Borgen, to have the County advertise for two new motor graders, motion carried.  The two new motor graders would replace George Brusseau and Robert Hall’s motor graders.

Richard Flanders made a motion to adjourn the meeting, seconded by Harvey Hope, motion carried.
